1. These Terms and Conditions govern participation in $500 Gift Certificate Give Away (“promotion”) sponsored by Adrenaline Inc 801 W Adams St Suite 211, Chicago IL 60607 – Phone number 1 888 992 3736 action@adrenaline365.com (“Promoter”).
2. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
3. Entrants must be 18 years or over. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. Promotion commences February 3,2023. Entries close at February 13, 2023 (Promotional Period).
ENTRY
5. To enter, eligible entrants must, during the Promotional Period, visit www.adrenaline.com (Website), follow the prompts to the promotion entry page, input the requested details and submit the fully completed entry form.
6. Any cost associated with accessing the Website is an entrant’s responsibility and is dependent on the Internet service provider used.
7. One (1) entry awarded per entrant. Incomplete, indecipherable, or illegible entries will be deemed invalid. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.
8. The use of any automated entry software, services or any other mechanical or electronic means that allows an entrant to automatically enter is prohibited and will render the entry submitted by that entrant invalid. An entry must contain a current and valid email address to be a valid entry.
9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, email address and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights
10. If there is a dispute as to the identity or email address of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity or email address of the entrant.
SELECTION OF WINNERS
11. Winners will be selected by a random drawing, which will take place at Adrenaline Inc., 904 West Ave. Austin, Tx on February 14, 2023 (2/14/2023). Winners will be notified in writing and their names will be published on the Website and associated social media pages. In the event of a business or corporate entrant being drawn as a winner, the prize will be awarded to the business or corporation to allocate the prize. The Promoter’s decision is final and no correspondence will be entered into.
12. Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
GRAND PRIZE
13. The first valid entry drawn will win a $500 Gift Certificate. (Grand Prize).
14. The Grand Prize includes a single Adrenaline Gift Certificate to the value of $500 USD.
15. The winner of the Grand Prize (“Winner”) may be required to present valid identification and to sign documents including a publicity release, liability waiver and affidavit of eligibility. Failure to sign and return the required documents may result in the Winner’s entry being disqualified, the Winner’s rights to the Grand Prize being forfeited and a new winner being selected.
16. The Grand Prize may be redeemed for Adrenaline Experiences (“Activities”) through the Adrenaline Website. The Grand Prize may not be redeemed directly with experience providers.
17. The Grand Prize is subject to standard terms and conditions of individual prize and service providers.
18. Additional information regarding Activities are available on the Website. Winners of Adrenaline Experiences may be required to hold a current valid driver’s licence issued in an US State or Territory to participate in the Adrenaline Experience.
19. Upon redeeming the Grand Prize, Winners and their companion/s (if any) acknowledge that Activities are dangerous and may result in injury or death, and participate at their own risk. Winners and their companion/s (if any) must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Promoter and Activity organisers as determined by them in their absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Activity; (c) not be under the influence of drugs or alcohol; (d) comply with all directions of the Promoter and Activity organisers at all times; and (e) wear all safety and other equipment required. The Promoter and Activity organisers, in their absolute discretion, at all times reserve the right to: (a) prevent any winner or his/her companion/s (if any) from participating in the Activity if, at any time, they reasonably believe that the winner or his/her companion/s (if any) poses a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous.
20. Travel to and from an Activity is the responsibility of each winner and his/her companion/s (if any) and is not included. Adrenaline Gift Certificate must be used by December 24, 2012 (12/24/2018) and Activities are subject to booking availability. If an Activity is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered.
21. Adrenaline Experiences are subject to the venue terms and conditions, including any applicable age restriction. The Promoter and organisers hereby expressly reserve the right to reject any winner and/or his/her companion/s (if any) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of an Adrenaline Experience prize.
GENERAL
22. Any ancillary costs associated with being awarded or redeeming a prize (including, but not limited to, federal, state and local taxes or any other applicable fees or costs not expressly identified above that are related to participation in the Contest and the acceptance and/or use the Prizes) are the sole responsibility of the Winner. Any unused balance of an Adrenaline Gift Certificate will not be awarded as cash. Redemption of Adrenaline Gift Certificate is subject to any terms and conditions of the issuer including those specified on the Adrenaline Gift Certificate. Winners cannot assign or transfer their prizes to any other person or entity.
23. As a condition of accepting a prize, a winner and his/her/their companion/s must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers/operators in their absolute discretion, including but not limited to a legal release and indemnity form.
24. If for any reason a winner does not take a prize (or an element of a prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
25. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
26. The Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize for any reason and without notice.
27. Total prize pool value is $500 in the form of a single Adrenaline Gift Certificate.
28. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
29. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) modify, suspend, terminate or cancel the promotion, as appropriate.
30. A draw for any unclaimed prizes may take place at the same time and place as the original draw, subject to any directions from a regulatory authority.
31. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
32. The Promoter (including its respective officers, employees and agents) disclaims all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
33. Without limiting the foregoing, the Promoter (including its respective officers, employees and agents) is not responsible for and disclaims all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
34. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers.. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
35. Except where prohibited, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually in Chicago, Illinois; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees or court costs; and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant, Administrator, and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Illinois without giving effect to any choice of law or conflict of law rules (whether of the State of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Illinois.
